Opportunistoc Advance with Hive Commander?

Is there anything, anywhere that states if you can or cannot use the Opportunistic Advance stratagem in the shooting phase with Swarmlords Hive Commander ability in 9th ed? Since it says you can move and advance if you wish as if it were your movement phase.

Opportunistic Advance is only usable in the Movement Phase, as per the wording of the stratagem itself. Even if the unit can move in the Shooting Phase as if it were the Movement Phase, it is still the Shooting Phase for stratagem use. The Movement Phase portion was probably written before Normal Move and Advance rules were finalized.

I think there's a rare rules or a 9e FAQ that forbids the use of a strategem out of phase. I can't recall the exact location of that rule however

The section on 'Out Of Phase Rules' on that page says that rules that apply during a particular phase do work on actions that take place as though it were that phase, with the one exception of stratagems. You can't use a stratagem which is for a particular phase on an out of phase action.
