Disembark from engaged transport?

Does a unit disbarking from an engaged transport count as having fallen back?

Can a unit in an engaged open top transport still shoot?

A disembarking unit counts as having moved, but not as having fallen back.

Any restrictions applied to the shooting of an open topped vehicle are also applied to its passengers. So no shooting while it's in combat (except with pistols).

In Wh40K 9th edition have new rule called "Big guns never tire".

This rule allows vehicles to shoot all non blast weapons, even if they are in close combat,but you will have -1 hit modifier to heavy weapons and you must shoot to units, that are engaged with the vehicle at first.
For example you can decide to shoot all heavy stubbers from achilles to engaging astra militarum infantry squad and decide to shoot your heavy mining laser (that are blast, so you cannot shoot them in engaging range) to near leman russ. If The infantry squad is destroyed by hails of heavy stubber fire, you can shoot your heavy mining laser to leman russ.

Interesting question is now, if we have Goliath Truck with neophytes inside, can they shoot in to close combat?
Open-Topped says next: "Models embarked on this model can attack in their shooting phase. When they do so, any restrictions or modifiers that apply this model also apply to its passengers:..."

If Big guns never tire is a modifier, you can shoot your neophytes to close combat.
But if not, then you cannot.

If we read the rule, it does say, that the embarked models will shoot, not the Goliath Truck...

Which makes interesting case, that you can disembark from vehicle and shoot, but you cannot shoot from the vehicle.

Clarification from GW would be nice.

Modifiers are +1/-1 to hit and wound rolls. Nothing else.
It's saying that if the vehicle advanced, then the -1 to hit to assault weapons would also apply to any guys armed with assault weapons inside the vehicle. Same with moving and firing heavy (the vehicle has a rule to ignore this modifier, but it still exists, and the guys inside typically don't ignore it).

Being unable to fire while engaged is a restriction. Vehicles have the Big Guns Never Tire rule which lets them ignore that restriction with certain weapons. But the guys embarked inside the vehicle typically do not have a rule that lets them ignore it.

But are the models embarked considered as engaged ? If you think about it they can’t hit the opponent unit engaging their transport.

They aren't engaged, but the transport they are in is. Restrictions are passed to the occupants, so the restriction about being unable to fire while engaged gets passed along.

But if the 7nit disembarks then it can shoot, assault, just fine no ? Sorry if this was already discussed previously

Correct, if the unit disembarks then it's able to act normally.

Keep in mind that in order to disembark the whole unit must be within 3” of the vehicle. If they can’t fulfill this requirement they can’t disembark. This doesn’t come up much when cracking vehicles with monstrous creatures, but could be very relevant when tying up vehicles with your gaunts.

I suppose they could still use the emergency disembark stratigem, but that has its own negative consequences.

Ok, anybody to play the tyrranocytes with 6" pile in and 360 degrees consolidate and go charging stuff only to lock them in combat and have the passengers disembark and charge the following turn?

The T-Cyte is not a transport in that aspect. It is droppod. Units inside must disembark as soon as it is deployed.
I have seen battlereports on youtube (playtesters😱) get this wrong. But it is well described in the rules.

They can not disembark at all? I thought the rest just got destroyed. Perhaps I am mixing that and emergency disembark rules.
