How to deal with a commison fail?

Hey there,

I got a Bio Titan commissioned off of a painter that goes by the name Crippled Bristles. He seems to of vanished. I paid him a fair bit of money for the project and he started posting pics of the model on his page. Then he messaged me saying he was going through a divorce and I haven't heard since. Since I was paying on a weekly basis and it's been a while I can't get my money back. So what should I do?

Have you ever posted on Bartertown? They have a guide on how to deal with a situation like this.

Basically, this is fraud and you should contact his local police department. Collect as much information as possible and have it ready when you call.

I say ask for the model as is. Hope for the best and try to work something out. Contacting the police will likely not get you the results you want and could make him avoid you. If you live in the area you could file a claim in small claims court, but otherwise it would be tough.

He's stated that the offender hasn't been contacting him anymore, so working out a deal with someone is rather unlikely.

There are numerous instances where it has resulted in a police visiting a fraud offender and the victim has had their models being returned.

So, if the person isn't going to return any messages, then there isn't much other options left to do.

Send him a written letter, recorded/ signed for. An email too. (keep evidence of both). Basically stating that you are sorry for his predicament but you have given him adequate time (have you?) to rectify the situation in a fair way. You will be happy to wait longer upon his clarification for him to send a near full refund and your model back. Again state you sorry for his situation but without any communication you are forced to contact the police.

I'm in the UK, but i paid for some stuff once over a forum, not 40k related/ not that should matter. Guy ignored my emails/ msgs and phone calls. I rang police in his area, stated what had happened, whatcha know? The police rang me the same night saying it was all boxed up ready to go and he just "hadn't got round to posting it". I guess they were quick on it because he was probably already on their system.

You could also state you'll be making him a visit if the police don't do anything (only after some considerable time). If the distance is big, mention your friend has family up in that area and you just so happen to have some other friends who are willing to tag along. Depends how keen you are to have your Titan back. But the guy isn't one of the nobbers who just ignore cause they're lazy, he's just a little messed up, so time may just be the only cure.

Police in the US are way less likely to help. I had a dude steal my CC info and was charging it $700/night for a hotel room plus room service, going out to eat etc. I called the hotel and they stated he was in the room. I called local police and they said since I was in Orlando and they were in Philadelphia it wasn't theft in for them. I was at the bank and we called the manager of the hotel and explained the situation and he even refused to kick the people out! The bank manager calmly informed the hotel that they were taking all the funds back for fraud and that they would have nothing. Needless to say, my faith in the justice system is pretty low.

That sucks. The general consensus here is the police are useless also. But in this instance, US moreso. 

I don't understand why the US hasn't moved away from signing to use credit cards/ debit cards.

You got me. With all security breaches here you'd think they'd go to the chip and pin. We often adopt technology first but then don't upgrade to more efficient later. Our electric is still 110V.
